Background: The advances in science and technology increasingly lead to the appearance of ethical issues and to the complexity of care. Therefore, it is important to define the ethics position of students studying in health departments so that high quality patient care can be achieved. Objectives: The aim of this study was to examine the ethics position of the students at Shool of Health of an University in western Turkey. Methods: The study design was descriptive and cross-sectional. The study population (...) included 540 first, second, third, and fourth year students from the Departments of Nursing, Midwifery, and Rescue and Disaster Management in the 2013–2014 academic year. Data were collected with a Personal Identification Form and The Ethics Position Questionnaire. Obtained data were analyzed with Chi-square test, Confirmatory Factor Analysis, and Nested Analysis of Variance. Ethical considerations: Before conducting the research, approval was obtained from Ege University Clinical Research Ethics Committee in İzmir and written informed consent was taken from all the participants. Findings: There was no significant difference in the mean scores for the Ethics Position Questionnaire between the students in terms of years and fields of study. Although the mean scores for the subscale idealism did not differ between fields of study, the mean scores significantly differed between years of study. However, the mean scores for the subscale relativism did not differ in terms of years and fields of study. Discussion: Whether students are idealistic or relativistic in terms of ethical judgment will be effective in ethical decision-making skills during patient care. Therefore, we need to define the factors that influence students’ ethics position in the future. Conclusion: It is suggested that the courses and practices that teach students to be aware of their ethics position to create an ethical outlook can be placed in the curriculum in health schools. I feel deeply honored and privileged to have the opportunity of giving the first Baffi Lecture at the Bank of Italy. Paolo Baffi was not only a distinguished banker and financial expert, he was also a remarkable economist and a visionary social thinker. He had outstanding technical expertise in many different fields, but combined his intellectual eminence with a profound sense of values. As Governor Ciampi put it at the general meeting of the Bank of Italy last May, Paolo Baffi (...) represented “an extraordinary combination of penetrating logic, erudition and moral strength … [he was] not only a gifted student of economics, he had a deep-seated commitment to act for the common good.”1 In remembering Baffi today, we must keep in mind both his intellectual contributions and his general evaluative concerns. Le silence et le sommeil constituent la base sur laquelle la cure psychothérapeutique et la créativité humaine se produisent. Or c’est avec le concept de sens latéral que Merleau-Ponty a esquissé la structure phénomé­nologique de la créativité humaine. Du point de vue du sens latéral qui surgit au creux de l’articulation intentionnelle du monde, le corps vivant apparaît comme style qui canalise la production du sens. Chaque surgissement du sens latéral est précédé par un silence qui suspend momentanément l’intention­nalité thématisante (...) et articulante. Le corps comme style n’est pas le corps réel mais le corps imaginaire qui se situe au centre du monde imaginaire en le fabriquant et en le déformant. Le corps imaginaire engendre la « déforma­tion » par rapport à l’articulation objective du monde et cette déformation constitue l’essence de la créativité. La création artistique, la cure dans la psychothérapie et le rêve sont les exemples éminents de cette créativité. Par contre, dans le silence et le sommeil qui précèdent la création et le rêve, non seulement l’articulation intentionnelle mais aussi celle du corps imaginaire sont suspendues. Depuis la revolution scientifique du XVIIe siecle, la science est tourmentee par le sens a donner a sa propre entreprise. Plusieurs tentatives pour fonder l'intelligibilite de la nature sur les structures pretendument immuables de la raison ont echoue. Mais l'echec philosophique est a la mesure du succes aveuglant des connaissances scientifiques, qui n'ont plus que faire du scrupule de principe. Kant n'est-il pas un des avocats les plus eminents de ce scrupule tombe en desuetude? Face au divorce consomme entre physique (...) et metaphysique, il restait a se demander, avec Kant, ce que la raison a a gagner si chacune se force malgre tout a parler le langage de l'autre. Effort douloureux mais riche d'enseignement: si la physique est poussee dans cet horizon de la metaphysique qui lui est etranger, elle retrouve le moyen de s'aventurer dans une reflexion sur son propre point de depart. Reflexion qui hante encore la science aujourd'hui, meme si c'est a son insu. Dans ce premier geste il doit y avoir quelque chose de definitif: seule la philosophie kantienne de la nature nous met vraiment aux prises avec lui. A tort. Marcuse est d'abord un philosophe qui s'inspire de la grande tradition de la philosophie allemande, celle de Kant, Hegel et Marx. Commentateur scrupuleux de Hegel, Marcuse en produit une lecture critique vivifiante, loin des idées toutes faites sur ce maître éminent. Fidèle à Marx - mais pas aux marxisme standard, ce qui lui a valu l'hostilité de tous les gardiens du temple marxiste - il lie étroitement la critique sociale à la théorie analytique de Freud. Bref avec Marcuse, (...) c'est tout un pan de la culture moderne que nous sommes invités à reparcourir. Mais Marcuse est aussi l'un des penseurs de la théorie critique. Son objet, c'est la société industrielle avancée, la nôtre. On pourrait croire que ses oeuvres décrivent notre présent alors qu'elles ont été écrites voilà un demi-siècle et plus. La "désublimation répressive", l'utilisation du principe de plaisir au profit de la domination, c'est bien quelque chose qui a pris aujourd'hui une ampleur que l'on pouvait à peine soupçonner au moment où Marcuse écrit Eros et civilisation ou L'homme unidimensionnel. Comment ne pas voir que l'extension indéfinie du marketing et des techniques de la communication produisent cette uni-dimensionnalité de la pensée que Marcuse analyse et dénonce si vigoureusement? Enfin Marcuse est un philosophe de la culture. L'art et le sens du beau sont, pour lui, essentiellement libérateurs. S'il continue de penser nécessaires l'émancipation politique et la transformation des rapports sociaux, il sait que la libération humaine est celle de l'individu qui doit reprendre possession de lui-même en se débarrasser de l'aliénation. Il ne s'agit pas de dessiner un avenir plus rationnel mais surtout la perspective d'une vie plus libre et plus belle. (shrink)

Quel lien y a-t-il entre le style, qui exprime un rapport au monde, et la théologie qui engage un rapport à Dieu ? Ce lien a été très fort dans le passé. À travers Augustin et le Pseudo-Denys, la pensée néoplatonicienne transmet au Moyen Âge le thème de la lumière intelligible. L’univers médiéval s’appréhende comme un cosmos transfiguré par la lumière de Dieu qui s’irradie sur toutes choses. Les Sommes théologiques baignent dans ce même symbolisme lumineux. Cependant, la pensée scolastique, (...) sous l’influence de l’aristotélisme, prend une orientation divergente : le réalisme tend à séculariser la nature ; la clarté ne vient plus d'en haut, mais d'en bas, de l’objet : l’esthétique se détache du discours théologique, l'allégorie se libère du symbole en direction de l'imaginaire. Quel sens reconnaître à un tel cheminement marqué au sceau de notre modernité ? Un champ esthétique, devenu ainsi autonome, ne risque-t-il pas de se retrouver exclusivement voué aux jeux formels d’une fiction pure sur fond de néant de sens ? Non, car l'imaginaire exerce une « fonction métaphorique » et « ontologique » , qui ouvre vers un supplément de sens. Le style est une structure individualisante qui rend sensible, dans l’art, le jaillissement d'une vérité du monde qui se répète dans les diverses productions esthétiques d'une même aire culturelle. Un style peut donc être un « lieu théologique » porteur d'un certain rapport au sacré, au même titre que « trace séculière » de formes spirituelles les plus diverses. D’où l’éminente leçon de « L'art sacré » contemporain, attentif aux affinités, techniques et défis de la modernité et, partant, promis aux rencontres œcuméniques les plus enrichissantes.What connection is there between style that expresses a relationship with the world, and theology that engages a relationship with God ? This connection was very strong in the past. From Augustine and the Pseudo-Dionysius, Neoplatonic thought transmitted to the Middle Ages the theme of intelligible light. The medieval universe is understood as a cosmos transfigured by God’s light irradiating all things. Theological Summas bathe in the same luminous symbolism. Under Aristotelian influence, Scholastic thought, however, takes a divergent orientation : realism tends to secularize nature ; clarity does net come from on high, but below, from the object ; the aesthetic detaches itself from the theological discourse, allegory frees itself from the symbol in the direction of the imaginary. What meaning can be seen in such a path that is marked with the seal of our modernity ? Does not the aesthetic field, that has become autonomous, take the risk of finding itself exclusively dedicated to formal games of pure fiction on a background of meaninglessness ? No, for the imaginary exercises a « metaphorical » and « ontological » function that opens towards an increase of meaning. The style is a individualizing structure that renders sensitive, in art, the breaking out of a truth of the world that repeats itself in the diverse aesthetic productions of a same cultural space. A style can, therefore, be a « theological site » carrying a certain rapport to the sacred, and at the same time that « secular pathway » of the most diverse spiritual forms. From there comes the eminent lesson of contemporary « Sacred Art », attentive to the affinities, techniques, and challenges of modernity, and consequently, engaged to most enriching ecumenical encounters. On examine deux cas, Martha Nussbaum, qui soutient que la littérature, en particulier le roman, peut induire des analyses morales bien supérieures à celles des philosophes, et Maria Zambrano, philosophe et poète, qui soutient que c'est le même Logos qui est à l'oeuvre dans les deux domaines. Par le style, et par le souci conjoint de la signification, la poésie a (...) un sens philosophique. L'histoire de la pensée ne peut pas négliger le rôle eminent de la poésie philosophique à travers l'histoire : Chateaubriand, Paul Valéry, Paul Claudel ont accompli une œuvre littéraire d'une grande portée philosophique. Literature and philosophy keep obvious relationships since a few philosophers are poets too, such as Lucretius, or writers, as Montaigne. Here we examine two cases: on the one hand that of Martha Nussbaum, who supports that only literature, in particular the novel, can lead to moral analyses much superior to those of the philosophers, and, on the other hand, that of Maria Zambrano, both a philosopher and a poet, who supports that it is the same Logos which is at stake in both fields. By the style, and through the joint concern of meaning, the poetry has a philosophical meaning. The history of thought cannot neglect the prominent part played by philosophical poetry throughout history: Chateaubriand, Paul Valéry, Paul Claudel carried out a literary work of a long lasting philosophical range. Il manifeste un interet constant pour des questions scientifiques variees (physique, theorie des couleurs, chimie, meteorologie, geologie, mineralogie, morphologie, botanique, zoologie) et influencera profondement la philosophie allemande de la nature des annees 1780-1830. Goethe est une reference incontournable pour la Naturphilosophie tant idealiste (Kant, Schelling, Hegel) que romantique (Holderlin, Novalis, Schlegel). Il est, selon l'historien de la philosophie Johann Hoffmeister, parmi la nebuleuse (...) heterogene des philosophes de la nature, comme " le Soleil au milieu des planetes ". Goethe meme considere ses ecrits scientifiques comme un volet majeur de son oeuvre, et dialogue avec d'eminents savants de son temps (Cuvier, Geoffroy Saint Hilaire, les freres Humboldt). Sa Naturphilosophie articule une theorie de la connaissance a une redefinition de l'experience privilegiant le recours a l'intuition visuelle, ainsi que la recherche de " phenomenes originaires " (Urphanomene) et des metamorphoses auxquelles ils donnent lieu. Hegel louera dans la Naturphilosophie de Goethe " l'intuition pleine de sens [...] qui ordonne ce qui n'est que phenomene d'une maniere conforme a la suite interieure du concept ". Le present ouvrage eclaire ce Goethe Naturphilosoph fondateur d'une episteme intuitionniste, phenomeniste, voire phenomenologique, aux antipodes de la science physico-mathematique, quantitative et intellectuelle, de Descartes ou Newton et inaugurant un style original de comprehension des phenomenes naturels qui se joue des frontieres a la fois entre les disciplines scientifiques et entre la philosophie et son autre (science, litterature). Bastiat is widely acknowledged as the most effective advocate of free markets, but his status as an economist is widely denied even by prominent Austrian economists who share his literary style and support for liberty. In particular, his theories of value and exchange have been attacked as a labor theory of value. Bastiat is exonerated here from these charges and is shown to fully oppose objective theories of value and to fully endorse the gains from free exchange. In addition, Bastiat (...) viewed economics as a science based on deductive reasoning and he vehemently opposed the use of mathematics. He thus was an important precursor of the Austrian school of economics.Bastiat est très reconnu comme étant le défenseur le plus éloquent du libre marché. Cependant, son statut en tant qu’économiste est amplement nié, et ce, même par les économistes Autrichiens éminents qui sont en accord avec son style littéraire et sa défense de la liberté. En particulier, ses théories de la valeur et de l’échange, considérées comme participant de la théorie de la valeur-travail, ont fait l’objet de critiques. Cet article exonère Bastiat de ces critiques et démontre que ses théories s’opposent radicalement aux théories objectives de la valeur : Bastiat avait une compréhension parfaite des gains découlant des échanges libres. De plus, Bastiat envisageait l’économie comme une science reposant sur un raisonnement déductif et s’opposait résolument à l’emploi des mathématiques. The emerging new multidisciplinary and crosscultural field of bioethics will require sen sitive, open-minded professionals to take the lead in hospital ethics, in genetic coun selling, and in the teaching of bioethics to students in nursing, medicine and the basic sciences. Nurses with ward experience who return to university to gain an MA or PhD in bioethics are eminently suited for this leadership role, for they may be more likely than physicians to study for a liberal education to supplement their (...) professional know ledge ; their first-hand experience in nursing is an antidote to the pointless subtleties into which philosophical ethics so often degenerates. When teaching ethics to nurses one must remember that, while some will simply use this knowledge in their own clinical work, others will go on to be teachers and researchers in bioethics. Their training must therefore be broad and interdisciplinary, including real substantive philosophy (as opposed to philosophical ethics), as well as mystical bioethics, religious law, ethics of genetic counselling, clinical approaches to ethical pseudo prob lems, research skills, etc. (shrink)

L’article présente les propositions principales de la métaphysique du réalisme axiologique de Tadeusz Czeżowski, l’un des représentants éminents de l’École de Lvov-Varsovie. La thèse soutenue par Czeżowski est que les valeurs ne sont pas des propriétés de n’importe quel genre, mais qu’elles constituent des notions transcendentales au sens de Duns Scot (et pas au sens de Thomas d’Aquin). Une des conséquences de cette position est que le réalisme de Czeżowski a la forme d’un non-naturalisme. Alimentada pelas concepções filosóficas da Modernidade, esta tendência foi constantemente enfatizada pelas teorias educacionais até hoje influentes nos meios pedagógicos, além de sedimentada pelas limitações próprias ao modelo escolar amplamente instituído. A crítica e a superação desse modo de ser configura-se hoje (...) como urgência eminentemente política de enfrentamento das múltiplas ameaças que pesam hoje sobre a sociedade brasileira, e particularmente sobre todos os grupos que fazem corpo contra a intolerância, contra o racismo, enfim contra o que Achille Mbembé denominou necropolítica. Fueled by the philosophical conceptions of Modernity, this tendency was constantly emphasized by the educational theories that are still influential in the pedagogical environments, being sedimented by the inherent limitations of the widely established school model. The criticism and the overcoming of this way of being is configured today as an eminently political urgency to confront the multiple threats to Brazilian society, and particularly to all groups that make body against intolerance, against racism, and finally against Achille Mbembé called “necropolitics”. But is the philosophy of education prepared to meet such an urgency? Key-words: body-world; cosmopolitanism; philosophy of education; decoloniality; human paideia. This means (...) that Christianity itself has been the main influence in changing the very relationship between the Infinite and the finite, between God and the world. In stressing the divine Transcendence, the world becomes fully autonomous. Ferry recognizes the impact of Christianity on contemporary culture. Christianity is not just the religion of the incarnation of God; it is also the religion of the divinization of man. According to Ferry, contemporary humanism has many transcendental traits which are derived from its roots in Christianity. The author thinks that there is large support for the idea that Christianity and contemporary humanism are not so opposed to oneanother as many have thought. It might rather be the case that those two phenomena are sides of the same coin, at a different period of critical awareness. It would follow from this that religion can only survive if it takes far more seriously the challenges addressed by it by contemporary humanism, and starts to see in it not so much its opposite as its ally. All this is the result of a major shift in the very meaning of the word “God” in Christianity as the religion of the Incarnation. (shrink)

La linguistique arabe est sans aucun doute la première science conçue et cultivée en arabe pour répondre à certains besoins scientifiques et idéologiques de la nouvelle société islamique. Les premiers travaux en ce domaine datent du VIII e siècle, et leurs auteurs, les premiers linguistes, sont précisément contemporains de l'arabisation des institutions, de l'administration, de la monnaie etc., sous le Khalife Omeyade ʿAbd al-Malik ibn Marwān. Ces premiers travaux étaient intimement liés à l'exégèse coranique, à l'orthoépie coranique, à la jurisprudence (...) islamique, c'est-à-dire aux disciplines associées à l'organisation de la nouvelle société et à sa culture. C'est à cette époque qu'Abū al-Aswad al-Duʾalī inventa des signes graphiques permettant de distinguer les différentes fonctions grammaticales des éléments linguistiques. C'est à la même époque que l'on a engagé la codification massive et systématique des données de l'arabe, comme en témoignent, à peine plus tard, les travaux d'ʿAbdallāh ibn Isḥāq , d'Abū ʿAmr ibn al-ʿAlāʾ et de bien d'autres. Ils ont également initié l'étude de la grammaire au sens large, puisque celle du système phonétique y est incluse. Tous ces travaux ont tracé la voie de plusieurs disciplines: phonologie, phonétique, métrique, lexicographie, et favorisé la naissance des grandes théories du langage. Et, de fait, au cours de la seconde moitié du VIII e siècle, al-Khalīl ibn Aḥmad a fondé plusieurs de ces disciplines. Sa connaissance des mathématiques et son recours aux procédés combinatoires l'ont aidé non seulement à inventer des disciplines telles que la métrique et la lexicographie, mais aussi à formuler les catégories grammaticales. Son élève, l'éminent linguiste Sībawayh, a ensuite codifié la plupart des analyses et des explications d'al-Khalīl, et les a enrichies en maintes occasions. Cette période héroïque de la linguistique arabe s'est prolongée grâce à de grands successeurs qui vont fonder des écoles linguistiques à Bassorah, Kufa, Bagdad, etc. D'autres écoles ont également vu le jour à Fuṣṭāṭ et ailleurs, et la recherche linguistique va ainsi se poursuivre jusqu'à la fin du XI e siècle, au moins. Le premier Congrès pour l’unité de la science (Congrès international de philosophie scientifique) qui s’est tenu à Paris en 1935 comprenait deux sessions, consacrées l’une à l’induction, l’autre aux probabilités. Des représentants éminents du mouvement pour une philosophie scientifique ont présenté des communications dans ces sessions: dans la première sont intervenus Hans Reichenbach, Moritz Schlick et Rudolf Carnap, dans la seconde, Reichenbach, Bruno de Finetti, Zygmunt Zawirski, Schlick et Janina Hosiasson, — dans cet ordre. Les sujets abordés concernaient la nature (...) des lois scientifiques, le problème du sens et le principe de l’empirisme, ainsi que des questions connexes portant sur la confirmation des hypothèses scientifiques. Sur la nature des probabilités, les principales interprétations étaient représentées, à savoir le logicisme, le fréquentisme et le subjectivisme. Fut également examinée la possibilité de construire une logique probabiliste. Ce chapitre passe en revue les différentes contributions présentées dans ces deux sessions, à partir du texte publié dans les actes du Congrès. (shrink)

Axel Honneth, célèbre théoricien allemand de la reconnaissance qui s’inscrit dans la filiation de l’École de Francfort et notamment de Jürgen Habermas, et Jacques Rancière, éminent penseur français de la mésentente qui a rompu avec la tradition althussérienne, sont deux figures centrales du paysage intellectuel contemporain. Leurs pensées se situent dans deux traditions distinctes, mais elles ont toutes deux à voir avec le marxisme pris au sens large, qu’elles considèrent sous un angle critique. Les deux penseurs portent intérêt à des (...) domaines spécifiques au sein de la philosophie et hors d’elle. S’ils partagent tous deux un souci du domaine politique, Axel Honneth se meut dans la philosophie sociale, la philosophie morale et la philosophie du droit ; il fait un usage important et réfléchi des sciences sociales. Jacques Rancière se tourne, pour sa part, vers l’histoire, l’esthétique et la littérature. Mais une confrontation entre leurs deux pensées paraît s’imposer, tant leurs modèles sont influents dans le champ des sciences sociales, de la théorie politique et de la philosophie critique aujourd’hui. Il s’agit de savoir si les paradigmes qu’ils mettent en avant pour critiquer la société, pour rendre raison de son évolution et des transformations qui doivent la rendre plus juste ou plus libre, le paradigme de la reconnaissance et celui de la mésentente, sont concurrents, s’ils sont exclusifs l’un de l’autre, ou s’ils sont compatibles. I. Les facultés qui se rapportent à l'image des objets en nous, — l'imagination au sens large, — constituent, selon une tradition qui vient d'Aristote, l'intermédiaire entre la sensibilité et l'intellect. Le moyen âge les désigna par le nom de sens intérieurs ; leur liste fut reprise et modifiée par Ficin (dont la source directe n'est pas Avicenne, mais Albert le Grand) et par Bruno. Dans l'interprétation des néoplatoniciens, la série des facultés connaissantes représente le chemin de l'âme dans la (...) conversion ; la phantasia y joue un rôle eminent (Plotin, Hugues de Saint-Victor, Ficin, Bruno) ; d'autre part, on fait correspondre à la faculté intermédiaire une âme intermédiaire qui lui sert de substrat (Lulle), et un « premier corps » ou « véhicule » de l'âme (le spiritus phantasticus ou őχημα-πνεῦμα de Synesius). L'idée reparaît, modifiée, chez Hugues de Saint-Victor, Ficin, Bruno. Ce dernier met le spiritus phantasticus en relation avec l'âme du monde, qui lui est consubstantielle, la « lumière précédant toute Création » qui nous fait voir les images de nos rêves. Sources : Porphyre, Cusanus repris par Ficin, le panthéisme médiéval. Le lien entre le spiritus phantasticus et le destin de l'âme, esquissé chez Plotin, Porphyre, le Pseudo-Jamblique, Synesius, est affirmé sous différentes formes par Hugues, Ficin et Bruno : le sujet des peines infernales, qui sont d'ailleurs chez Ficin et Bruno de nature imaginaire, est un corps subtil. Ces peines correspondent exactement à ce que nos appétits et notre imagination ont fait de la substance de notre âme. Le spiritus phantasticus se rapproche, notamment chez Ficin, d'une sorte de karma. II. Dans la branche descendante de la connaissance, l'application de l'universel au particulier est forcément liée au sens intérieur et on l'attribue à une faculté spéciale, la Urteilskraft au sens kantien. Bruno en fait une fonction de l'imagination. D'autre part, les arts universels ou lulliens ont pris de plus en plus, durant la Renaissance, l'aspect de topiques généralisées ; le nerf de la méthode y était donc toujours cette Urteilskraft. Il s'en suit, chez Bruno, que le sujet de l'art universel est l'imagination, qui devient ainsi la source première de tout acte de l'intellect, principe de la fécondité infinie de la pensée. (Pratiquement, d'ailleurs, les artes de Bruno sont des ensembles d'images). III. Aux théories de l'imagination répondent les théories de l'image, « vêtement » et « premier corps » de la pensée. On vérifie cette correspondance, d'une part, dans la théorie du symbole, — avec ses variantes métaphysiques, pansymbolisme, magie, — et, d'autre part, dans celle du concetto (rapport entre la pensée et l'expression), où l'on va jusqu'à l'idée d'un universel de l'imagination, et du dessin comme concept. — Une importante différence entre la nature du symbolisme selon Pic et l'idée que s'en fait Bruno s'explique par leurs conceptions différentes de l'imagination. La théorie de l'art et l'évolution du goût artistique sont, dans leurs grandes lignes, en concordance avec ce qu'impliquent ou suggèrent à ce sujet les théories de l'imagination et de l'image. Émile Meyerson (1859-1933), philosophe français, juif d'origine polonaise, chimiste formé en Allemagne, a élaboré une œuvre de philosophie des sciences considérable, forte de plusieurs volumes, qui embrasse les conceptions de la science classique comme les principes de la thermodynamique, la théorie de la relativité et la mécanique quantique. L'œuvre de Meyerson a longtemps été négligée dans la tradition épistémologique française, alors qu'elle avait rallié à elle nombre des physiciens aussi éminents qu'Einstein et de Broglie ou des psychiatres comme Minkowski et (...) le jeune Lacan. La " philosophie de l'intellect " de Meyerson fait de la recherche d'invariants dans la nature le principe fondamental de la raison et le ressort inaperçu de l'histoire des sciences. Elle a su aussi bien s'expliquer avec la pensée idéaliste allemande qu'interroger le fonctionnement du sens commun. Elle a entretenu des relations complexes avec certaines théories majeures de son temps, celles de Brunschvicg et de Bachelard, ou celles de Frege et de Schlick. Par son analyse des paradigmes scientifiques du passé, Meyerson annonce Koyré et Kuhn, qui se sont d'ailleurs réclamés de lui. Il ouvre ainsi des perspectives plus que jamais d'actualité dans les débats contemporains en philosophie des sciences. (shrink)

"La métaphysique de tradition analytique ou continentale est florissante. Elle n'est plus seulement travaillée comme objet de l'histoire de la philosophie, elle est redevenue sujet de l'activité philosophique et productrice d'oeuvres nouvelles - qu'il s'agisse de la tradition dite continentale ou de celle dite analytique. Du côté "continental", hérité de Heidegger, c'est estimer que la métaphysique, en tant qu'enquête rationnelle sur l'être, doit être dépassée au profit d'un questionnement poétique. Du côté analytique, hérité du Cercle de Vienne, et notamment de (...) Carnap, c'est prolonger l'oeuvre de philosophes qui estimaient que la logique symbolique nouvellement façonnée devait permettre d'établir le fait que tous les énoncés métaphysiques étaient dénués de sens. L'apologiste de la science que fut Carnap, tout comme son pourfendeur que fut Heidegger, ont l'un et l'autre convergé sur un même mot d'ordre :"le dépassement de la métaphysique". Ce renouveau actuel est donc d'autant plus étonnant que ces deux courants se réclamaient l'un et l'autre de l'héritage de Kant, lequel récusait déjà la triple ambition de la métaphysique théorique à connaître rationnellement la surnature, les choses en soi et les faits ultimes constituant la nature. This book develops some of the most important themes of Sen's works over the last decade. He argues in a rich and subtle approach that we should be concerned with people's capabilities rather than their resources or welfare.

In the summer of 1997, I was asked by a leading Japanese newspaper what I thought was the most important thing that had happened in the twentieth century. I found this to be an unusually thought-provoking question, since so many things of gravity have happened over the last hundred years. The European empires, especially the British and French ones that had so dominated the nineteenth century, came to an end. We witnessed two world wars. We saw the rise and fall (...) of fascism and Nazism. The century witnessed the rise of communism, and its fall (as in the former Soviet bloc) or radical transformation (as in China). We also saw a shift from the economic dominance of the West to a new economic balance much more dominated by Japan and East and Southeast Asia. Even though that region is going through some financial and economic problems right now, this is not going to nullify the shift in the balance of the world economy that has occurred over many decades (in the case of Japan, through nearly the entire century). In this paper, in answering the question why Kant didn’t think very highly of music, I argue that for Kant (i) music unlike other art forms, lends itself more easily to combination judgments involving judgments of sense, which increases the propensity to make aesthetic mistakes and is ill-suited as an activity for improving one’s taste; (ii) music expresses aesthetic ideas and presents rational ideas only by taking advantage of existing associations while other art forms do so by breaking with the (...) laws of association and creating new associations. I propose that (ii) constitutes the reason why music is not a rich source for reflection and thereby cannot stimulate the enlargement of the cognitive faculties. Given that the standard Kant uses in setting up the hierarchy of fine arts in terms of their cultivating role is the enlargement of cognitive faculties, this explains why music is placed at the bottom of his hierarchy. The article aims to analyze the legal norms that regulate the protection of the property right in the legal system of the Republic of Macedonia. In most cases, the protection of property right is realized through suits; however, our legal system provides for the possibility that the protection of property right can also be realized through the registration of immovable property rights in the respective Public Registries. Given the fact that in the Republic of North Macedonia the normative regulation of (...) property suits is not contained in a single normative act, but rather extends to several such acts, the article, based on the practice of the high courts, seeks to analyze the legal cases related to property rights that qualify as rights similar to property rights, but which enjoy legal protection provided by law. The article will mainly elaborate on the basic provisions on property protection suits contained in the Law on Ownership and other Real Rights (2001). However, in this context, the provisions on property protection that are contained in the Law on Real Estate Cadastre (2008), the Law on Contentious Procedure (2005), the Law on Securing of Claims (2007), the Law on Construction Land (2008), etc., will also be taken into consideration. The aim of this study is to explore the role and the importance of the notary service in the process of dejudicialization of the judicial-civil protection. In this context, this paper first of all attempts to examine the extent to which the issues from the traditional competence of the court have been transferred to notary publics and the possibilities of further extension of this transfer. The judicial framework for the transfer of these issues from the court competences to that of (...) notary publics has been decided by the Law on Non-Litigious Procedure. In supporting this law, the notary publics undertook the realization of a series of activities in this field, namely in the field of inheritance. In this respect, the idea of this paper was to try to identify other judicial issues that could perhaps be entrusted to the notary publics in the future, by carrying out a judicial-political assessment of the public interest to transfer the resolution of certain issues to notary publics′ competences with the aim of facilitating the judicial circulation and increasing judicial security. This article aims to expound the principle of justice, as a fundamental value and as an immanent category of law, as well as one of the fundamental human rights, prescribed and guaranteed by a myriad of international instruments and documents. After a brief historical account, by focusing on Article 40 of the Magna Carta Libertatum, which states that: “To No One Will we Sell, To No One Will we refuse or delay, right or justice”, this article claims to show the (...) importance of incorporation of this principle in the provisions of the Magna Carta and its impact on the development of theory and legislation in the past and present. Moreover, the article intends to explore the extent of influence that the priciple of justice has on the functioning of the law in general. Since justice implicates the permanent and constant will to render each person his due, and this achieved through equality, it results that justice means being equal. In this context, the article will explore the concept of equality as a precondition of justice, as well as the conditions and modalities for its implementation. Having in mind that the principle of justice is closely linked to the principle of equity, because equity precedes justice, or more precisely, equity is considered a source of justice, this article seeks to articulate the essential distinctions between these two concepts by focusing on their methods, i.e. in their approach for putting the idea of equality into action. This research article analyzes the right of disposal of marital property in relation to the undertaking of those legal actions that imply the highest authorizations that legal subjects can have over things. Having in consideration the fact that according to the legislation in the Republic of Macedonia, marital property is joint as are the authorizations of spouses over their joint items, it is important to determine the extent of the disposal, i.e. who disposes of the items of the joint property (...) and to what extent. Referring to the normative framework, which regulates disposal relations of spouses, the article emphasizes the concept and importance of the authorization of disposal of things, through legal activities. In this context, the article tends to draw a divisive line between the administration with the joint item, referring to continuative actions and measures and the disposal of the thing, which is not continuative but, due to legal consequences it causes, has great importance in practice, and as a result, enjoys greater attention in legislators in terms of its limitation compared to the acts of administration with joint items in marriage. Murâbıtlar Devleti’nin temeli Kuzey Afrika’daki kabileler arasında irşad ve tebliğ faaliyetinde bulunan ve bu maksatla bir ribat kuran Mâlikî fakihi Abdullah b. Yâsîn tarafından atılmıştır. Mâlikî mezhebine mensup olan ve bu mezhebin esas alınması hususunda büyük hassasiyet gösteren Murâbıtlar Devleti emîrleri devletin kuruluş gayesine sadık kalmışlar, karar alırken fakihlere danışmışlar, onların fetvâları ve tavsiyeleri doğrultusunda devleti yönetmişlerdir. Bu durum fakihlerin tesir sahasının oldukça geniş olmasına (...) sebebiyet vermiştir. Murâbıtlar Devleti, fakihlerin bu devlette büyük bir otoriteye sahip olmaları ve bilhassa onların fetvâları ile vuku bulan hadiseler sebebiyle yıkılışından itibaren çeşitli değerlendirmelere konu olmuştur. Bu devlete son vererek bu devletin topraklarında hüküm süren Muvahhidler, müsteşrikler ve bir kısım araştırmacılar Murâbıtlar Devleti’ne tamamen olumsuz bir bakış açısıyla yaklaşmış, çeşitli ithamlarda bulunmuşlardır. Diğer taraftan bilhassa son dönemlerde bu suçlamalara cevap niteliği taşıyan çalışmalar da yapılmış, eserler ortaya konulmuştur. Bu çalışmada öncelikle Murâbıtlar Devleti’nde en önemli makam olarak kabul edilen kādılık makamını ihraz eden fakihlerin yetki ve sorumlulukları hakkında bilgi verilmiştir. Sonrasında devletin zirve döneminde hüküm sahibi olmuş Yûsuf b. Taşfîn ve Ali b. Yûsuf b. Taşfîn’in fakihlerle ilişkileri ile fakihlerin bu emîrlerin döneminde cereyan eden önemli hadise ve kararlardaki rolü ele alınmıştır. Çalışmanın son kısmında ise Murâbıtlar Devleti’nde fakihlerin konumu ve etkisi ile alakalı olarak yapılan değerlendirmelere yer verilmiştir. (shrink)
